Kerry Magnus Coaching Client Agreement

TERMS OF PURCHASE AGREEMENT

BY PURCHASING THE 4 MONTH FATIGUE TO FLOW COACHING PACKAGE (“PROGRAM”) FROM THE COACH, THE CLIENT AGREES TO THE FOLLOWING TERMS OF THIS PURCHASE AGREEMENT (“AGREEMENT”):

I understand that coaching is a structure that facilitates the process of personal, professional, and/or spiritual development, and transformation; and that it is not a substitute for medical advice, psychotherapy or counselling.

I agree that while Kerry has psychology training the coaching does not equate to a psychotherapeutic or medical process and that Kerry may recommend I seek the support of a physician, psychologist, or counsellor, for medical, emotional or psychological reasons beyond what the coaching covers.

I also agree that I will share any emotional discomfort or anxiety, should these arise, with Kerry, so that she will be able to properly support me in a timeous fashion.

I understand that any information, history or current experiences I share with Kerry will be kept in strict confidentiality. However, I also understand that Kerry is under an obligation to share with any other necessary parties any concerns about the mental health of clients whom she believes could be a threat to themselves or the wellbeing of others.

PROGRAM STRUCTURE

This Program entails eight (8) in-person, online sessions as well as three (3) bonus BodyTalk sessions (to be carried out at some point during the four (4) months depending on the judgement of Kerry).

The eight (8) sessions will begin once the initial payment is received and will need to be completed within a four (4) month period from the date of signing this agreement. Any sessions not scheduled during the course of this time period will be forfeited.

I understand that my eight (8) sixty (60) minute coaching sessions will be held by Zoom/Skype or agreed alternative, and agree to show up for my calls, on time, or to inform Kerry 24 hours in advance if I need to reschedule, or am running behind. I understand that should I fail to call into my coaching session at the scheduled time, I will forfeit the minutes that I am late, for that session, or the entire session if I do not show up at all.

I understand that should I need to reschedule a session, it will be rescheduled according to Kerry’s availability.

I understand that in addition to my scheduled sessions, I may receive support by email and Kerry will respond as timeously as possible.

PAYMENT

The total price of this Package is $1300 or four payments of $397 to be paid monthly. I agree that these monthly payments will be due by no later than the 4th of each month and will be paid in full by the completion of all eight (8) sessions.

I acknowledge that should I fail to make my monthly payment of $397 within five (5) days of the agreed time, Kerry may postpone sessions until payment has been made. If I fail to make my payment by the 20th day of the month, without satisfactory arrangements, Kerry may terminate the coaching agreement.

I acknowledge that all payments and deposits are non-refundable.

CLIENT RESPONSIBILITY

I understand that coaching is a collaboration between Coach and Client, and that a firm commitment is needed to get the lasting and significant results I desire. I understand that my private coaching agreement is a commitment of eight (8) sessions, to give me the very best opportunity to create lasting change and actualise my transformations.

I commit to invest my time, to show up for my calls, complete my objectives to the best of my ability; and make my appropriate payments, to stay in integrity to the commitment to myself, and to Kerry, in order to achieve the fastest, and most significant results; from the coaching process.

I understand that coaching is a collaboration, and partnership, between Coach and Client; and that the results I get are based on me, my efforts, and consistency; and that I alone, am responsible for the outcome.

I agree to bring the best of myself to my coaching calls, and to reserve the space for my sessions as sacred. I agree to come as prepared and focused, as I am capable, and to limit my possibilities for distractions; to have the best coaching experience possible.

I understand that for the coaching process to work, the coaching relationship is based on mutual trust, and understanding; therefore, I commit to discuss any issues I have with the coaching approach/ process, with Kerry; and to make the best possible effort to communicate any concerns in an authentic, and truthful manner, so that my issue can be resolved; and a coaching relationship of trust and partnership can be restored, to continue my journey of success.

INDEMNITY

In no event shall Coach Kerry Magnus be liable for any actual, direct, indirect, special, punitive, incidental, exemplary or consequential damages; or any other damages whatsoever, including, but not limited to, injury or fatal injury.

COPYRIGHT

I agree not to reproduce, duplicate, copy, sell, trade, resell or exploit for any commercial purposes, any portion of Coach Kerry Magnus’s materials or program, use of the Program, or access to the Program, without written permission from Kerry.

I understand copyrighted and original materials shall be provided to me as Client for my individual use only and a single-user license. I acknowledge that I am not authorised to use any of Kerry’s intellectual property for my business purposes, and that I shall not be authorised to share, copy, distribute, or otherwise disseminate any materials received from Kerry, electronically or otherwise, without the prior written consent of Kerry Magnus.

All intellectual property, including Coach Kerry Magnus’s copyrighted coaching materials, shall remain the sole property of Kerry. No license to sell or distribute Kerry’s materials is granted or implied.

BWRT WAIVER

I understand that Kerry may make use of Brain Working Recursive Therapy (BWRT) during the course of the coaching. I further understand that The British Brainworking Research Society (BBRS) does not recognise the use of alternative therapies, such as BodyTalk, which Kerry will also be making use of. These are two separate and unrelated therapies and BWRT can in no way be compared to or connected to BodyTalk.

I, [mbr_db_first_name] [mbr_db_last_name], understand that the BodyTalk session provided by this Certified BodyTalk Practitioner is intended to enhance relaxation, increase communication within the areas of the body, and to educate me to possible energetic, emotional or mental blocks that may create pain and disease.

BodyTalk is non-invasive, safe, and objective. It utilizes the body’s own innate intelligence to re-establish communication within itself.

I understand that BodyTalk is not a substitute for medical treatment or medications. I am aware that the BodyTalk
Practitioner does not diagnose illness or disease nor does the Practitioner prescribe medications.

I understand that BodyTalk is distinct from Psychotherapy and BWRT and is not recognised as a Psychology modality or accepted by British Brainworking Society.
